wird auf den Schriftsatz des Privatklägers vom 24. Juni erwidert:

Die Tat des Privatklägers und Widerangeklagten ist im Inlande verübt, weildie „Fackel“ mit Wissen und Kenntnisdes Privatklägers in Deutschland verbreitetwird. Dass der Privatkläger davon Kenntnishatte, ergibt schon die Tatsache, dass erselbst zugleich der Verleger ist. Danach istjeder Ort in Deutschland, wo mit Kenntnisdes Privatklägers die Fackel verbreitet wird,Ort der Tat, also auch Berlin.

§ 7 Absatz 2, Satz 1, St.P.O. (ausschliessliches Forum am Erscheinensort) bezieht sichnur auf im Inland erscheinende Druckschriften,Absatz 2 Satz 2 daselbst konstatiert nocheinmal, dass der Verbreitungsort an sichdas forum delicti commissi ist. Uebrigensist das selbstverständlich.

Die Berufung des Privatklägers auf St.G.B.§ 4 ist deshalb verfehlt.

Es wird beantragt,

das Hauptverfahren auch auf die Widerklagezu eröffnen.
